Argument-giving reasons for a view-is our model of rational dispute resolution. Fogelin suggests that certain "deep" disagreements cannot be resolved in this way because features of their context "undercut the conditions essential to arguing" . In this paper we add some detail to Fogelin's treatment of intractable disagreements. In doing so we distinguish between his relatively modest claim that some disputes cannot be resolved through argument and his more radical claim that such disputes are beyond rational resolution. Starting with this issue, Teaching Philosophy will initiate a series of articles entitled “How to Teach.” The aim of these articles is to provide an overview of how to teach a particular course commonly offered in philosophy departments and programs, with the hope that the articles will assist those who are asked to teach a course unfamiliar to them. This dissertation argues that recent theoretical attempts to understand fallacious reasoning fail because these theories presuppose problematic accounts of the nature of argument. Current fallacy theories agree that a fallacy is a mistake, but differ wildly about what sort of mistake it is. Chapters one through three explore three very different suggestions. Chapter one is devoted to an examination of the oldest of the modern theoretical accounts of fallacious reasoning, what Hamblin calls the standard treatment. Chapter two begins with a (...) discussion of Finocchiaro's skeptical argument against the very possibility of a fallacy theory. It then turns to a discussion of van Eemeren and Grootendorst's pragma-dialectical treatment of fallacious reasoning as a possible response to Finocchiaro's skeptical challenge. Chapter three examines two epistemic responses to Finocchiaro's analysis: Fogelin and Duggan's frequency treatment and Wreen's mistaken inference treatment. The first three chapters set the stage for an alternative account of fallacies developed in chapter four. This alternative view of fallacious reasoning is consistent with Wright's recent work on the concept of an argument. It suggests that fallacious reasoning results from a kind of incompetency. Such failures of competency, however, are not nearly as common as traditional accounts of fallacious reasoning suggests. Moreover, the very possibility of being tempted by fallacious reasoning depends on our being very competent in normal cases. Chapter four ends with a discussion of some of the implications of this alternative theory of fallacious reasoning for the way we understand and teach argument and reasoning. (shrink)

In the appropriate contexts reasoning is a powerful tool for producing intersubjective agreement about what counts as the best answer to a question that generates inquiry; sometimes employing arguments can lead to agreement about what is the right answer. In this paper we hope to show, however, that unabashed optimism about the power of argument is misplaced. Such optimism rests on an implausible picture of the power of articulation. Sentences cashed out as reasons to believe another sentence is true cannot (...) bridge large gaps in substantive understanding. A failure to realize this fact, moreover, leads to an uncautious and unreflective optimism about the power of argument that ultimately threatens the very reasons-giving process. What is needed, then, is a much more modest sense of the role of argument. (shrink)

In Ruling Passions, Simon Blackburn contends that we should reject sensibility theory because it serves to support a conservative complacency. Blackburn's strategy is attractive in that it seeks to win this metaethical dispute – which ultimately stems from a deep disagreement over antireductionism – on the basis of an uncontroversial normative consideration. Therefore, Blackburn seems to offer an easy solution to an apparently intractable debate. We will show, however, that Blackburn's argument against sensibility theory does not succeed; it is no (...) more supportive of conservative complacency than Blackburn's noncognitivism. A victory for noncognitivism cannot be so easily won. (shrink)

We initially characterize what we’ll call existence problems as problems where there is evidence that a putative entity exists and this evidence is not easily dismissed; however, the evidence is not adequate to justify the claim that the entity exists, and in particular the entity hasn’t been detected. The putative entity is elusive. We then offer a strategy for determining whether an existence problem is philosophical or scientific. According to this strategy (1) existence problems are characterized in terms of causal (...) roles, and (2) these problems are categorized as scientific or philosophical on the basis of the epistemic context of putative realizers. We argue that the first step of the strategy is necessary to avoid begging the question with regard to categorization of existence problems, and the second step categorizes existence problems on the basis of a distinction between two ways in which an entity can be elusive. This distinction between kinds of elusiveness takes as background a standard account of inference to the best explanation. Applying this strategy, we argue that the existence of a multiverse is a scientific problem. (shrink)

In La Téntation de Saint Antoine Gustave Flaubert dramatizes a philosophical exchange about the nature of divine providence and the efficacy of petitionary prayer. The Devil and Antony consider the question of whether God can be called upon for relief from suffering. The Saint assumes as popular religion teaches that it is possible to ask for God's help in emergency situations, while the Devil poses a dilemma to challenge Antony's faith. The Devil seeks to expose contradictions in some (...) of the beliefs Antony holds about God's infinite perfection. The Devil's argument purports to prove that God is not a person, and that for this reason God is inaccessible to human interaction. The Devil's dilemma is supposed to be this: If God as an infinitely perfect being created the universe, then divine providence is not needed [does not exist]. If divine providence is needed [exists], then the universe is defective [not the creation of God as an infinitely perfect being].Although these look at first to be the opposite poles of an excluded middle, propositions and are mere contrapositives. Since the Devil's propositions and are logically equivalent, the Devil can only proceed to the conclusion that God does not exist or that divine providence is not needed or does not exist paradoxically by assuming that God exists or that divine providence is needed or exists. Yet if divine providence is needed or exists, then God exists as its divine source. If the Devil is supposed to succeed by logic, his dilemma as Flaubert portrays it is powerless to prove that the only reasonable religious attitude is an impassionate metaphysical acknowledgement of the existence of an impersonal infinitely perfect Substance, which is absolute unchanging unmoveable Being. The scope of Philosophy in Multiple Voices provides the reader with eight philosophical streams of thought-African-American, Afro-Caribbean, Asian-American, Feminist, Latin-American, Lesbian, Native-American and Queer-that introduce readers to alternative, complex philosophical questions concerning gendered, sexed, racial and ethnic identities, canon formation, and meta-philosophy. The overriding theme of the text is that philosophy is pluralistic in voice, rich in diversity, and ought to valorize democratic intellectual spaces of philosophical engagement.

John Stuart Mill's defense of freedom of discussion in On Liberty remains a major influence on philosophical and public debates about free speech. By highlighting underappreciated textual evidence and key distinctions, this introduction attempts to show how the contributions of the symposium authors – Melina Constantine Bell, Rafael Cejudo, Christopher Macleod, and Dale E. Miller – point toward a more complete account of Mill's views.

In the fourteenth paragraph of the fifth chapter of Utilitarianism, J. S. Mill writes that ‘We do not call anything wrong, unless we mean to imply that a person ought to be punished in some way or other for doing it; if not by law, by the opinion of his fellow-creatures; if not by opinion, by the reproaches of his own conscience.’ I criticize the attempts of three commentators who have recently presented act-utilitarian readings of Mill – Roger Crisp, David (...) Dale Dorsey considers one of the most fundamental questions in philosophical ethics: to what extent do the demands of morality have normative authority over us and our lives? Must we conform to moral requirements? Most who have addressed this question have treated the normative significance of morality as simply a fact to be explained. But Dorsey argues that this traditional assumption is misguided. According to Dorsey, not only are we not required to conform to moral demands, conforming to morality's (...) demands will not always even be normatively permissible---moral behavior can be wrong. This view is significant not only for understanding the content and force of the moral point of view, but also for understanding the basic elements of how one ought to live. (shrink)

The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. Much of knowing what to do is knowing what to do for ourselves, but knowing how to act in our best interest is complex---we must know what benefits us, what burdens us, and how these facts present and constitute considerations in favor of action. Additionally, we must know how we should weigh our interests at different times---past, present, and future. A better written introduction to what the Philosophy for Children Program is meant to be like in sustained practice is not likely to be found than this book. There have been transcripts published of good philosophical discussions by children accompanied with insightful commentary in Analytic Teaching and Thinking: The Journal of Philosophy for Children. Yet before this book, there has not been a comprehensive sampling of such discussions with a commentary that pulls it all together. What makes it even more (...) attractive is that it is written so that the primary focus is places where it should be - namely, on the children's philosophical inquiries as something worthy of the reader's attention for their own sake, rather than on some extrinsic concern such as a theory about children's thinking, a discussion of the Philosophy for Children Program, or a set of philosophical theses that the children just happen to have been exploring. Review of Foundations of Evidence Law, by Alex Stein.

Concern about two problems runs through the work of davidson: the problem of accounting for the "explanatory force" of rational explanations, and the problem posed for materialism by the apparent anomalousness of psychological events. davidson believes that his view of mental causation, imbedded in his theory of "anomalous monism," can provide satisfactory answers to both questions. however, it is argued in this paper that davidson's program contains a fundamental inconsistency; that his metaphysics, while grounding the doctrine of anomalous monism, makes (...) impossible a successful response to the problem of explanatory force in terms of a causal theory of action. This article examines a post-war generation of academics in the United States and in Britain, who, coming from lower-class families without any previous experience of university education, became internationally famous but nevertheless continued to feel out of place in the academic world. Pierre Bourdieu’s framework of habitus, field and doxa is useful in studying the world of such outsiders and exiles who shaped post-war sociology. Without an established canon of sociology, these students typically developed critical and creative perspectives on society. (...) In Britain the post-war welfare state was the foundation of this new breed of academics. John O’Neill is the classic example. In America ‘The Disobedient Generation’ were influenced by race, the Vietnam War, and the draft. William Connolly and Stephen Turner provide two case studies of highly successful academics who were often subjectively outsiders. ‘Event’ and ‘hazard’ imply that successful careers are in fact merely accidental. Neoliberalism may have closed off such accidental careers. (shrink)

Dispositional essentialists are typically committed to two claims: that properties are individuated by their causal role (‘causal structuralism’), and that natural necessity is to be explained by appeal to these causal roles (‘dispositional actualism’). I argue that these two claims cannot be simultaneously maintained; and that the correct response is to deny dispositional actualism. Causal structuralism remains an attractive position, but doesn’t in fact provide much support for dispositional essentialism.

Dale Jacquette charts the development of Schopenhauer's ideas from the time of his early dissertation on The Fourfold Root of the Principle of Sufficient Reason through the two editions of his magnum opus The World as Will and Representation to his later collections of philosophical aphorisms and competition essays. Jacquette explores the central topics in Schopenhauer's philosophy including his metaphysics of the world as representation and Will, his so-called pessimistic philosophical appraisal of the human condition, his examination of the (...) concept of death, his dualistic analysis of free will, and his simplified non-Kantian theory of morality. Jacquette shows how these many complex themes fit together in a unified portrait of Schopenhauer's philosophy. The synthesis of Plato, Kant and Buddhist and Hindu ideas is given particular attention as is his influence on Nietzsche, first a follower and then arch opponent of Schopenhauer's thought, and the early Wittgenstein. The book provides a comprehensive and in-depth historical and philosophical introduction to Schopenhauer's distinctive contribution to philosophy. (shrink)

Intuitively it has seemed to many that our concepts conscious state and conscious creature are sharp rather than vague, that they can have no borderline cases. On the other hand, many who take conscious states to be identical to, or realized by, complex physical states are committed to the vagueness of those concepts. In the paper I argue that conscious state and conscious creature are sharp by presenting four necessary conditions for conceiving borderline cases in general, and showing that some (...) of those conditions cannot be met with conscious state. I conclude that conscious state is sharp, and the conclusion is then extended to conscious creature. The paper ends with a brief discussion of some implications. (shrink)

Locke's contribution to the discussion was fourfold: First , he saw the importance of the problem; Second , he realized that the puzzle cases, the “strange suppositions,” were relevant; Third , he maintained “same” had a different meaning when applied to “person” from its meaning in other contexts; and, Fourth , he offered his much criticized solution of the problem.

Who Must Presume Whom to Be Innocent of What? This paper explores the roles that the presumption of innocence (PoI) can play beyond the criminal trial, in other dealings that citizens may have with the criminal law and its officials. It grounds the PoI in a wider notion of the civic trust that citizens owe each other, and that the state owes its citizens: by attending to the roles that citizens may find themselves playing in relation to the criminal law (...) (such roles as suspect, defendant, convicted offender and ‘ex-offender’), we can see both how a PoI protects us, beyond the confines of the trial, against various kinds of coercion, and how that PoI is modified or qualified as we acquire certain roles. To develop and illustrate this argument, I pay particular attention to the roles of defendant (both during the trial and while awaiting trial) and of ‘ex-offender,’ and to the duties that such roles bring with them.
